Well…Barack Obama won the presidency and no matter how you feel about that; one thing's for sure. Things are going to change. That was his campaign slogan right? How will that 'change' impact the IRS and their ability and willingness to collect delinquent taxes? I'm glad you asked. It is very likely that due to the worsening economy and rising deficit that IRS collections will continue to increase. The federal government has dramatically increased hiring in the areas of border enforcement and the Transportation Safety Administration. Since the IRS is actually the agency responsible for the collection of federal government revenue, it only makes sense that one of the first priorities of an Obama administration would be to increase hiring of IRS collection personell. This course of action even fits with the campaign rhetoric that the rich should pay their share. So don't be surprised if IRS collection continues to accelerate to unprecendeted levels in an Obama administration. To be fair, John McCain would have likely done something very similar. Take a look at the special video that I prepared addressing this situation:

Picture this. A room of 50 attorneys/paralegals most of whom have no experience whatsoever in the IRS niche. They came to Denver, Colorado to learn what they needed to know to begin representing clients with IRS Problems. It would be impolite to say how much they paid, but it was a considerable amount of money, to learn from me, Tampa Tax Attorney, Darrin T. Mish. I opened up my case files (with client identities protected of course) to teach them the ins and outs of IRS representation.

Know this, it was no simple seminar. These guys and gals came to learn hardcore cutting edge techniques for the resolution of IRS Problems. It wasn't like I gave them easy fact patterns to make them feel good.

Day One

Probably over 80% of these professionals have never handled an IRS case. They had no idea what to do when an IRS problem client came into the office. We spent 8 hours going over the ins and outs of IRS Problem representation and I left their heads spinning. But here's a little secret. I could tell that stuff was sticking in their heads. I had faith in them and faith in the system of teaching that I have created. I knew this group would make the cut. On Monday, they would be in their offices helping normal taxpayers like you and me with their problems with the IRS. I was more than a little excited.

Day Two

Well….day one was mostly me and day two is mostly them. What I mean by that is that is that Day Two is all Case Studies. I give the group real life fact patterns and they have to come up with the BEST solution to solve it. As normal, in the morning it was a bit rocky but after lunch these new IRS tax tigers came alive! They were coming up with the solution to problems within 5 minutes! I was prouder than a daddy at a kindergarten graduation. This group was definitely going to make it. Heck they weren't just going to make it, they were going to become fire breathing IRS Problem Resolution animals! I was so proud and so fulfilled.

P.S. In case any of the attendees read this, I really am proud of your progress. Go get them. The sky's the limit. YOU can do whatever you set your mind to.

Today, I’m coming from sunny Denver, Colorado. Why am I in Denver? I’m here as the main speaker for a two day seminar teaching attorneys and enrolled agents and CPAs the finer aspects of IRS problem resolution. I’ll be taking them from A-Z with over 16 hours of content. I’m going to be bearing my secrets gained over years of experience in having represented hundreds and hundreds of IRS problem resolution clients. You might ask yourself, why would I do that? Why would I train my competition? Because I don’t believe in competition, and I like to help people. I like to help people like you, and like me, and like these practitioners who are aching to get out there in the trenches and help people like you and I with their IRS problems. You might ask yourself, why do I need representation for an IRS problem case? The answer is simple. The IRS has its own well known, well archived, list of arcane rules and regulations, and they deal in that world every day. The simple fact of the matter is that you don’t. There are traps and pitfalls waiting for people who are unwary and unrepresented. I can't tell you how many times that I have seen taxpayers who have fallen into the clutches of unscrupulous IRS revenue officers and agents. Now I’m not saying that all revenue officers and agents are unscrupulous, and I’m not saying that they're all bad; most of them do their job quite well and they use the utmost morals and respect for taxpayers. But that doesn’t mean that they're going to be looking out for you. Their job is to look out for the federal government, not you. On the other hand, when you're represented preferably by an attorney, your best interests are being looked out for by that attorney. He or she is there to make sure that you don’t get taken advantage of. If you already have an attorney, there is a good chance that I either know him or her, or I had a hand in training them. We’ve done these seminars on several occasions, and we’ve done several teleseminars as well. Wish me luck, because there is a good chance that the attorney, CPA, or enrolled agent that you hire in your town to help you with your IRS problem is here, or I’ve had a hand in training them at some point in the past. Take care, and good luck with your IRS problems. Remember …. IRS problems don’t solve themselves.

The National Taxpayer Advocate, Nina Olsen, urged Congress to grant her discretion to make tax free IRS apology payments to citizens wronged by the actions of the Internal Revenue Service. The National Taxpayer Advocate is independently appointed by Congress to help oversee the actions of the Internal Revenue Service and to report annually to Congress with observations and recommendations. In her annual Report to Congress issued on January 9, 2008, Ms. Olsen indicates that our tax system is based upon a "social contract" between the government and its taxpayers. As part of this social contract, taxpayers agree to voluntarily report their earnings and pay their taxes and the government agrees to provide the oversight and "service" necessary to insure that taxpayers can and will do so. According to Ms. Olsen, such a fair tax system should ensure that not only taxpayer's mistakes are penalized. Obviously the IRS makes mistakes and therefore should not be held harmless when they do so. In cases, where "such situations cause excessive expense or undue burden on the taxpayer, she proposes that an IRS apology payment is in order. These payments will range from $100 to $1000 and would be reserved primarily for special cases. Her office would retain total discretion to issue such payments and they would be tax free!! I personally think that this is a great step in the right direction! As a Tax Attorney focusing on IRS Problem Resolution, I see IRS abuse and incompetence on a daily basis. Most IRS employees are diligently attempting to perform their difficult job with limited resources, however I routinely come across IRS employees who act as if the IRS is above the law and that private citizens have no recourse against injustice. IRS Apology Payments will make a small incentive for the IRS to follow the law and properly observe the rights of every taxpaying American citizen. Hopefully taxpayers with IRS Problems will now be better able to resolve them without enduring abuse or mistakes at the hands of the IRS.

Here is the video of Republican Presidential Candidate Ron Paul and his views about getting rid of the IRS that I previously promised. Although I don't necessarily agree with everything that he advocates, I do think his views are very interesting. If you currently have an IRS Problem, I think getting rid of the IRS might be an idea you might want to consider. I do think that the government tends to abuse the rights of individual citizens. Public "servants" often forget who pays their salaries in an effort to exercise their authority. The IRS must follow specific rules promulgated under the RRIA 1998. I might be able to help you navigate the maze of IRS rules and regulations. If so, don't hesitate to give us a call. Here's the Ron Paul video:

I just ran across this short video of an interview with Republican Presidential candidate, John McCain. He talks about simplifying the tax code and what steps he is willing to take to get it done. He won't endorse a flat tax (he's not brave enough for that) but he does seem like he's willing to move in the right direction. Very briefly he even talks about the abolishment of the IRS, then slips back into politician doublespeak. What worries me about this interview is that he keeps talking about a commission to study the problem. Isn't that what government does? They study the problem without ever coming up with a solution. Next I'll try to find an interview with Republican Presidential candidate Ron Paul. From what I understand, there's a man with a plan. He advocates getting rid of the income tax and the IRS altogether! Here's the John McCain interview:

Did you know that even though the Exxon Valdez oil spill catastrophe was in 1989 that IRS levies (garnishments) relating back to the Exxon lawsuit are still valid? Most of these IRS levies were issued in the period dating from 1994 to 1996. Even though the collection statute of limitations (CSED) has long since expired, they attached to a fixed and determinable right to future payments, namely the Exxon Valdez lawsuit proceeds.

Many fishermen and others whose livelihoods depended upon a clean environment and clean seawater in the Prince William Sound area of Alaska have been waiting on the Exxon settlement for over a decade. Although the original trial court's verdict was a judgment in the amount of $5 billion, it has been appealed repeatedly over the past decade and a half. As late as December 2006, the judgment has been reduced to only $2.5 Billion but this decision remains on appeal as well.

Although it remains to be seen if the 32,000 hardworking members of the class who originally sued will ever get their money, the IRS maintains that levies issued in anticipation of the awards remain valid and enforceable. If you are a member of the class and need to deal with such a levy you can contact the Local Taxpayer Advocate Service (TAS) office in Alaska. You can reach TAS by calling the Anchorage TAS office locally at (907) 271-6877 or toll-free at 1-866-490-5449 or the TAS toll-free case intake line at 1-877-275-8271 or TTY/TDD 1-800-829-4059. If you happen to be looking for an Orlando Tax Attorney who can represent you in anywhere in the United States call tollfree (888) 438-6474.

Over the past several years, we have represented or consulted with clients on six continents. This represents every inhabited continent on the planet…or does it? Well I did some research on Antarctica. I have a five year old son who recently studied the continents in preschool. As he was running around the house chanting the continents, he got to the last one, Ant-art-ica (as he would say it) That got me to thinking. Aren't there some American scientists down in Antarctica? The Ross Ice Shelf rings some sort of bell way back in my mind. After I did my research, I found that there are actually three full time science stations in Antarctica manned by U.S. scientists. And at least one is likely to have some sort of IRS Problem. So if you are in Antarctica, give me a call or shoot me an email, I have a deal for you.
