<li> The IRS will also verify that you have made Estimated Tax Payments if you are required to do so. Many people fail to realize how important the paying of Estimated Tax Payments. Generally speaking if you are self-employed or if you had significant tax liabilities in the prior year, you are responsible for the payment of Estimated Tax Payments. A simple formula for determining your ES payments is to take last year&#039;s balance due, mulitiply it by .9 and then divide that figure by 4 to get your quarterly payment. Eg. If last year you owed $10,000 even, than multiply that by .9 which gives you $9000, then divide that by 4 which means your quarterly payment should be $2250. You can also break that number down by month and make your quarterly payments every month or even every week. It&#039;s a little known fact that taxpayers can pay their Estimated Tax Payments more frequently than quarterly but if you think about it, it makes sense. The government just wants their money. When you make an ES payment just make sure to use Form 1040ES for the current year and make sure to notate on the memo line of the check what period you wish for it to be applied against. If you fail to use the form 1040ES and/or forget to notate the memo line, the IRS might very well apply your ES payment against any outstanding balances that you have. That&#039;s a bad thing and will prevent you from ever exiting the mess that you are in.</li>
</ul>
<ul class="unIndentedList">
<li> You must get a clear handle on your ability to pay in the opinion of the IRS. How do you do that? Well&#8230;if you are dealing with the Automated Collection System (ACS) you go to www.irs.gov and download a form 433-F. If you are dealing with an IRS field Officer like a Revenue Officer or if you are dealing with IRS appeals, you will download a form 433-A. Lastly, if you have an incorporated business or Limited Liability Company you will need to fill out a form 433-B as well. It&#039;s helpful to know how the IRS allocates what are known as &#034;allowable expenses.&#034; But if you don&#039;t understand how they do it or if you just want to hire a seasoned professional to handle your matter for you, that would make sense as well. The point is that the IRS will use the difference between your income and your &#034;allowable expenses&#034; to come to a figure that they believe that you can pay toward your tax liability on a monthly basis. Eg. If your income is $5000 per month and your &#034;allowable expenses&#034; are $4000 per month, the IRS will demand that you pay $1000 per month toward your liability (especially if you owe more than $25,000). There are sometimes exceptions to that rule but it&#039;s a good guideline to remember.</li>

Make sure your tax returns have been filed; make sure you have made your estimated tax payments; and make sure you understand what the IRS thinks your ability to pay will be or you might find yourself with a situation that simply can&#039;t be solved.</p>

Try friends and family if you get no where with the bank. Paying the tax debt in full will allow you to keep your refunds each year, giving you additional funds to apply toward your principle. Second, if you can&#039;t get a loan hire a qualified professional to negotiate with the IRS on your behalf. Attorneys, CPAs and Enrolled Agents are admitted to represent taxpayers before the IRS. They can work to make sure your payments are applied to your tax debt, and limit the interest and penalties you end up paying. Lowering the principle will also lower the interest and penalties.</p>
<p>Third, if you have no other choice you can wait until your circumstances change. Worst case scenario is that you may have to wait for the Statute of Limitations to run out on your debt. The IRS has 10 years to collect tax from the date it is assessed. There are several things that can extend this collection period, educating yourself to avoid these actions will minimize any inadvertent extensions in the collection period. Of course this last option may not really be an option if you are faced with imminent collection activity like a tax lien, wage levy or property seizure. Truly your best option at preserving your rights and protecting your hard earned income is to hire a professional. If you&#039;re able to scrape up a few thousand dollars, hiring a professional is likely to yield better results than throwing that money at interest and penalties that accrue faster than your principle can be reduced.</p>

<p>If you marry someone that owes the IRS money and you live in or move to one of nine community property states, you may be on the hook for the premarital debt too. The day you get married all income becomes community property which is loosely defined to mean one-half of your income is hers and one-half of her income is yours. If the debt remains unpaid, the IRS can levy one-half your paycheck to pay for the tax bill of your new spouse that accrued prior to your marriage. If you later file a joint income tax return and you are due a refund, the IRS can keep the refund to pay towards the old debt (this will apply regardless of whether or not you live in a community property state).<br />
The only way to protect your money is to make sure your future spouse has filed all their tax returns and paid all their taxes. Run a credit report or search the public records at the county clerk&#039;s website for tax liens. Don&#039;t be fooled by fancy pre-marital agreements designating your income as separate property. Court rulings have granted the IRS the right to inspect and determine if the agreement has actually been followed. This includes depositing income into separately titled bank accounts and splitting marital household expenses equally. A unemployed spouse for a period during the marriage will allow the IRS to proceed as if the agreement did not exist.</p>

<p>Compliance Centers are spread across the United States to accept and process tax returns when they are filed. These centers are highly automated and IRS collection begins with basic error correction and computer analysis as returns are entered into the computers housed in these centers. As the computer processes each return error notices, balance due statements and audit alerts are all automatically generated. Each return requiring further collection is placed into a &#034;notice queue&#034; to receive a series of timely notices, each designed to increase compliance. Other avenues of IRS collection are closely tied to the timely delivery of these notices to a taxpayer. An untimely notice can hinder or even prevent further collection action by ACS or a Revenue Officer at a later date. It is nearly futile for a taxpayer to attempt to respond to a computer generated notice by writing the compliance center that generated the notice. As such IRS collection is almost always escalated to the ACS level if the taxpayer cannot full pay his or her liability upon receipt of the notice.</p>
<p>ACS facilitates IRS collection by giving the taxpayer an avenue to discuss minimal solutions to resolving his or her tax debt with an actual human being. ACS can levy wages and bank accounts as well as issue federal tax liens on a taxpayers account. The revenue agents that make outbound and take inbound phone calls have a lot of power to make a taxpayer&#039;s life difficult and to enforce IRS collection. These same revenue agents also have very little power to negotiate or improve a taxpayer&#039;s plight. Solution alternatives reached with ACS are often limited to <a href="http://getirshelp.com/installment-agreement.htm" target="_blank">installment agreements</a> and placing a taxpayer in <a href="http://getirshelp.com/currently-not-collectible.htm" target="_blank">&#034;hardship&#034; status</a>. IRS collection often gets its brute force reputation from the bank of ACS computers and call centers scattered across the United States. It&#039;s not an uncommon experience for a taxpayer to get lost in this complex &#034;maze&#034; and the pure frustration can become maddening. Often the frustration factor alone results in increased collection by the IRS because it&#039;s simply easier and more time efficient for some taxpayers to pay the computer generated bill, rather than fight it, even when the IRS is wrong.</p>
<p>Having a Revenue Officer assigned to an account is the most intense collection contact a taxpayer will have with the IRS. As the name implies a Revenue Officer is charged with the task of &#034;getting the money.&#034; If IRS collection efforts deem a taxpayer&#039;s account to be assigned to a Revenue Officer it will be sent to the office nearest the taxpayer&#039;s home. Revenue Officers are field agents and will often times show up on the taxpayer&#039;s doorstep. This part of IRS collection can be very intimidating and usually only occurs when accounts are severely non-compliant, or very complex in nature. Although the physical presence of an IRS agent at your front door, or a summons by a Revenue Officer to produce documents to his or her office can give a taxpayer heart palpitations, IRS collection is often most effective at this level. In large part simply having another human being to talk to face to face can facilitate resolution to a taxpayer&#039;s problem in a manner that is win-win for both the taxpayer and the IRS, even more so when a qualified representative is hired by the taxpayer to handle the matter.</p>

<p>In today’s world consumers are accustomed to “self service” and “do-it-yourself” options that touch just about every industry and every aspect of our lives, marketed to save us time and money. Need a new bathroom for your home? Just visit your local hardware store on a Saturday morning and attend the free class on bathroom remodeling. You’ll find yourself knee deep in a new home improvement project in a matter of hours. In a hurry and need a few quick grocery items on the weekend? No problem. When you’re ready to checkout at your local grocery store use the self-service register. No annoying clerk making small talk. No whiney kid being scolded by his mom and holding up the line. In and out, badabing badaboom, back home in no time.</p>
<p>No where over the last decade has “do-it-yourself” created more change and made more progress than in the financial services industry. Today nearly everyone banks online (or at least uses an ATM). Many manage their own retirement funds with an online investment account. Pull up any major brokerage firm on the web and you can attend webinars, read articles, and do research. It’s all at your finger tips, designed to save you countless hours, allow you to keep more of your hard-earned dollars, and let you be in control of your life. In our world of modern convenience why then is it so difficult for a taxpayer to resolve their “minor” tax problem on their own? After all, the IRS has one of the most efficiently run websites on the internet. It consistently receives top honors for its content and user friendliness.</p>
<p>The IRS even runs a marketing campaign informing taxpayers how “easy” it is to do business with the IRS. The IRS website prominently advertises, “can’t pay your taxes, set up a payment plan.” If the IRS is so user friendly now, why is it the average taxpayer gets so frustrated trying to solve a tax problem without professional help? Why is it that when the average taxpayer calls the phone number on their IRS notice that they spend an ungodly amount of time on hold? Why is it that when the average taxpayer calls the IRS on half a dozen different occasions about the same tax issue, they speak to six different people? Why is it that they actually get six completely different answers with each call? Why is it that on the seventh call the taxpayer’s “case” has been transferred to another department? The answer in it’s simplest form is, TAX PROBLEMS ARE NOT DO-IT-YOURSELF FRIENDLY!</p>
<p>One of the reasons why tax problems are not do-it-yourself friendly is that in the overwhelming majority of circumstances the first contact the taxpayer has with the IRS regarding a tax problem is through a computer generated notice or letter. The IRS has a ridiculously vast computer system and a series of call centers called the Automated Collections System (ACS). In the great majority of instances the tax problem is discovered by the computer system and a notice is automatically generated. No human being at the IRS actually knows exactly what the tax problem is at that moment in time. Another reason complicating matters and making tax problems difficult to solve without professional help, is that the lower level IRS employees answering the phone inquiries about these computer generated notices are not well trained in tax matters (or customer service for that matter). What they are well trained in is IRS “procedure.” That means they are well trained in the IRS system designed to do one thing and that is “collect the money.”</p>
<p>Compounding a taxpayer’s frustration is that as time passes, interest and penalties are accumulating. A simple tax problem can become a complex tax problem at blinding speed. However, TAXPAYER’S DO HAVE RIGHTS. Unfortunately the procedural steps to exercising these rights are often confusing and further must be implemented in a short period of time (usually 30 days or less). It’s almost impossible for the average taxpayer to gain a correct understanding on how to exercise their rights and then do so in this short amount of time. Frankly, most taxpayers that try to do it themselves screw it up. Further worsening their plight. The plain fact of the matter is that doing business with the IRS is not and won’t be (for the foreseeable future) “do-it-yourself” friendly for the taxpayer.</p>
<p>A competent professional can save you time, stress and money. Why? Simply, “it’s not their first rodeo.” A tax professional deals with the IRS and taxpayer problems all day, every day. Most taxpayers only have limited contact with the IRS regarding their own personal circumstances. A competent tax professional on the other hand has seen a wide variety of <a href="http://www.getirshelp.com/TampaCPA.htm">tax problems</a> regularly.
